You agree to DISCHARGE, HOLD HARMLESS INTENT, AND NOT TO SUE Fairy Box Shop and any of its owners, officers, directors, agents, representatives, employees, contractors, and board members from any and all damages, claims, demands, or causes of action that arise out of or are in any way connected with your purchases in person or online FOR ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE. When you agree to the Terms and Conditions you release Fairy Box Shop and its owners, officers, directors, representatives, employees, contractors, and board members from all damages, costs, charges, or expenses, including reasonable attorneys’ fees, incurred in connections with any such claim, demand, or action.

You agree to this release with awareness to personal risk and agree not to sue for yourself or on behalf of your heirs, executors, personal representatives, assigns and estates. All purchases are made by you the customer with full understanding that Fairy Box Shop is NOT LEGALLY RESPONSIBILE for any harm, misuse or damages as a result of or to the products and services. All legally responsibility for the products and services are strictly yours after purchase. You the customer understand and take full responsibility for your actions and consequences thereafter as a result of any product or service provided by Fairy Box Shop.

FDA DISCLAIMER

All herbal products are food-grade and recognized as GRAS (Generally Regarded As Safe) by the FDA, but it is essential to understand that they are marketed as curios and are mainly utilized for spiritual purposes and external use. We strongly recommend utilizing items as such. These items are not suitable for children, consumption, internal use or for medical purposes.

Statements and finalized versions of products made by Fairy Box Shop have not been evaluated by the Food and Drug Administration however, all products used by the Fairy Box Shop to create finalized products have been FDA approved as stated by manufactures.

TERMS OF SERVICE | TAROT READINGS

When booking a tarot reading service you agree to all terms of services and privacy policies written below as it relates to the service.
Please read over all terms of service prior to booking.

• General and in-depth: Personalized general and in-depth readings will be received within a maximum of 72 hours after booking and will be sent to the email used at check-out, Please ensure email used at checkout is correct.

• If you still have not received your reading within 72 hours of booking and have verified the correct email, please fill out a contact form here and I will make the appropriate changes to your order to ensure quality of service.

• Cancellations and refunds are NOT available for general and in-depth readings. All sales final.

• Live sessions, Phone calls and Text message - Readings available Tuesday through Thursday 2pm-6pm with 3-4 booking sessions available per day. These sessions may not be canceled for full reimbursement up to 72 hours prior to booked time. Cancellations made before 72 hours of booking will receive full refund. however, cancelations within 72 hours will issue refunds with a 25% cancellation fee. Cancellations made within 48 hours will be issued a 35% cancellation fee and cancellations made up to 24 hours will be issued a 45% cancellation fee.

• If client needs to reschedule for any reasons, you may reschedule booking without accumulating any additional fee’s, however, client may only reschedule a maximum of 1 time before booking is considered a cancelation and standard refund with a 35% cancellation fee will be issued for all live sessions, phone calls, and text messages.

• Live sessions. phone calls and text message readings are not to be used as an e-date or a means to connect with me inappropriately.

• Sexual harassment and inappropriate behavior or use of these services will not be tolerated.

• Abuse of Service will result in permanent ban and you will NOT be issued a refund of any amount.

Tarot Reading Services are regarded as spiritual support and should not be used in replacement of healthcare information as given by medical professionals. Tarot Readings are not a replacement for a diagnosis or healthcare advice. They are strictly spiritual support to healing and other life issues / See a doctor or licensed medical practitioner for all health-related issues. Information used and given through Tarot Reading Services are to assist in explaining and developing one's understanding of the beliefs within the metaphysical and spiritual community.

Fairy Box Shop will not provide Tarot Reading Services with the purpose to harm or mislead. Tarot Readings are not provided as a replacement to healthcare advice and no service provided will give a diagnosis or replace medical help. By agreeing to the terms of service as related to the Tarot Reading Services you agree that (a) you alone are responsible for yourself, all of your actions and results there after (b) Fairy Box Shop and any of it's owners are free from any and all liability.

All Tarot Reading Services are in agreement to all laws as it regards metaphysical and spiritual claims.

TERMS OF SERVICE | ART SALES

In order to purchase a commission art piece, whether digital, physical or other, you must agree to all terms of service provided here. Refusal to agree to all terms will result in denial of contractual agreement.

Upon agreement of all terms, buyer must sign a legally binding contract with Fairy Box Shop owner Stella Rose before proceeding. Contractual agreements are unique to each art piece and protect the buyer, artist and art piece from any unfair, unauthorized or illegal practices not agreed upon within the contract. Should the buyer or artist fail to comply with terms provided in contract, either party has the right to use legal action against the other to enforce agreement terms using the signed contractual agreement as evidence against the other.

• Buyer may not purchase commission art with the intention to copyright, redistribute, reproduce, collect payment, or alter art in anyway. All copyrights will remain with the artist, Stella Rose, even after sale is completed.

• Buyer understands that they will not retain, gain or purchase copyrights from the artist unless given explicit permission as agreed to within the contract. Buyer can request to purchase copyrights at any point. If buyer plans to use art for business purposes such as for a logo, copyrights will need to be discussed prior to contract signing.

• Buyer can also request art be used by third parties such as tattoo artists, without relinquishing agreement to terms.

• Buyer may not claim art as their own individual creation and use art for purposes other than to be displayed within the home. This includes, but is not limited to, showcasing art piece in galleries with claims to have been its original creator, sending art to be copied with the intention to gain profit, sending art to be copied and replicated by an other artist.

• Buyer may not alter art in anyway, including adding to or removing any paint, or additional media.

• Buyer must protect art from any inherit danger that may threaten the longevity of the art piece including, but not limited to, excess humidity, fire, sun damage or alteration as done by children and adults.

• Commission art sales require continued communication between buyer and artist. Buyer must remain respectful during all communications. Communication with artist, Stella Rose, is not an invitation to inappropriate, personal, or private conversations. Any inappropriate use of communication will result in a void of contract. This includes, but is not limited to, sexual harassment, perverted questioning and all otherwise irrelevant use of communication.

• Artist reserves the right to issue a void of contract at any point as a result of (a) inappropriate behavior; (b) sexual harassment'; (c) misuse of terms; (d) failure to follow terms as agreed upon within contract'; (e) safety concerns. A void of contract must be signed for buyer to receive refund. Refunds provided by artists digression.

• Refunds can be requested at any point between the date the contract is signed and up to 72 hours after work begins, however, refunds will be limited as it relates to the progression of the art piece. Artist reserves the right to deny any request to issue a refund and will issue a refund based upon how far along the art has progressed. A percentage of total sale is required as a deposit fee for all art sales over $200 and will not be refunded.

• You may not use, share or post any material sent by the artist during communication for any reason. No material shared between artist and buyer should be sent to a third party with the intent to steal, alter, copy or profit from. Any and all material, progress photos, and content as it relates to commission artwork is copyrighted by the artist. Failure to comply will result in full legal action.

• Terms of Service related to commission art sales are applicable to all traditional art sales, oddities and items otherwise made by Fairy Box Shop.

PRIVACY POLICY

This Policy explains how your data is collected and used when you purchase an item, contact me, or use a provided service through fairyboxshop.com or related websites including Etsy, Facebook, Instagram and YouTube. This Policy does not apply to the practices of third parties including stores where my products are sold, shipping services or the individual privacy policies of host websites and social media platforms used by Fairy Box Shop.

Third parties used by Fairy Box Shop: Squarespace, Stripe, Square, Cashapp, Etsy, Facebook, Instagram, YouTube, USPS will require their own terms of service and privacy policies as it relates to their platforms. Personal information and data will NOT be given to, sold, or used by third parties as a direct result of Fairy Box Shop. All personal information and data must be authorized by you through the individual and personal use of these platforms. For example: If you purchase an item through Etsy you are temporarily authorizing the use of your data through that platform so that you can receive a product.

We do not collect, store, or use personal data for any unauthorized, prohibited or illegal use.

Data must be collected by Fairy Box Shop to fulfill orders, shipments and services. This data may include, but is not limited to, your name, address, email, payment information and details of the product(s) you are ordering. To provide services through Fairy Box Shop, you must agree to the terms of services, privacy policies and other terms of use listed by Fairy Box Shop and Third Party Platforms. Information that is collected by Fairy Box Shop is strictly used to fulfil orders, uphold agreements and correspond to legal and fair use of data.

Through completion of orders you agree that your data may be used as required to complete orders, resolve disputes or claims against Fairy Box Shop, enforce agreement terms, and to comply with legal and regulatory obligations. Fairy Box Shop is in compliance with all laws regarding personal data and may use your information alongside law enforcement to (a) respond to legal process or to government requests; (b) enforce agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others. Information stored directly by Fairy Box Shop is held no more than 4 years or as agreed to by buyer.

Information may be stored longer than 4 years if (a) buyer purchases items frequently; (b) agrees to a newsletter, email alerts or other subscription services that may be provided by Fairy Box Shop; (c) buyer has broken terms of service, refused to pay,

YOUR RIGHTS

You have the right to request and receive a copy of all information stored about you as kept by Fairy Box Shop at a maximum of up to 4 years after an order is completed. Orders older than 4 years are no longer stored in the Fairy Box Shop data base. Information kept after 4 years of a completed order is maintained only by the buyer through continued use of services and products. This may include, but is not limited to, personal information such as name, address, and email used as part of an agreement to reoccurring subscription service such as the Fairy Box Shop newsletter.

You have the right to request all personal data be deleted, changed or restricted as it relates to the direct use of Fairy Box Shop except in cases where your information is required as part of an ongoing agreement. A cancellation of service must be agreed upon by both parties. Fairy Box Shop may also deny the request of deletion if there is compelling and legitimate grounds to continue using that information as needed for legal reasons. Information will otherwise be deleted.
